In January 1975 the Supreme Court issued a ruling in this case. What are the constitutional and legal issues raised by this case? Suppose you were writing the Court's opinion. In whose favor would you decide-for the students or for the school district?
i agree with the people that said the students need to have a fair chance to tell your side of the story because if you r like that kid who just got thrown down he/she should not be suspended from school!
ReplyDeleteI don't think all of the kids should be suspended.Basically the principle is blaming everyone in the cafeteria and that's wrong in my eyes.Think about it, if you were in a cafeteria and someone got into a fight and you didn't hurt anyone but someone hurt you and you got in trouble that's not cool.
ReplyDeleteI don't agree with the school board for punishing students they "thought" were involved in the violence. You shouldn't punish someone for something you think they did without exact proof they were involved. The students should have the right to a trial, because yes, suspension could permanently damage your records, or chance at future careers.
ReplyDeleteI think that the kids have the right to tell the principle their side of what happened. It was not fair that any kid that looked like they we're involved was suspended. But the Demonstration it was too violent and they shouldn't have done something that would put other people in danger and destroyed school property. It states in the the constitution that they have the right to say what they want. I can see both sides but since the kids were not allowed to tell their side and were punished without good reason, I think the kids were right.
ReplyDeleteThe case that i would choose is the students because the shouldn't suspend the kids that were not in the fight. I think they have the rights to do a petition because they should not be suspend for something they didn't do and if they try to tell them that they or not allowed they shouldn't listen because they have have the right its in the 1st amendment.I think they shouldn't have arrested them for doing a petition and for protesting because they have the right to petition or say.
ReplyDeleteIn this case, I don't think that the School district has the right to suspend all the who they THOUGHT were involved. Because they don't have the proof to show that all students were involved. They have the freedom of speech. Yes they were becoming violent, but not all the students were and they should get a fair opinion Not just suspended.

ReplyDeleteThe students have the right to have the Court listen to their case because the first amendment states that they have the right to have a petition and protest the way they want to and say what they want to say and tell the Court their side of the story. If the Court does not listen to the students side of the story then the people who were not involved would get punished for no reason.
ReplyDeleteI agree with with everyone comments. I think that the kids should all be able to tell there side of the story. It is not fair to the kids that didn't do it to be punished. The teachers should have stopped the kids before it got so bad. If there were police officers in the cafeteria I think it wouldn't of happened in the first place. They need proof before they get suspended. It's not fair. I would be mad if it were me that was suspended for not doing anything.
ReplyDeleteHey Emily, I agree with you. The school board didn't have good enough evidence to punish the students. They have a right to a hearing. If I was suspended for something I didn't do without a hearing I'd be mad. So they should have the same rights as everyone else!
ReplyDeleteIn this case I think it was not fair for the principal to suspend everybody who was in the cafeteria injured but not involved. He does not have the right to suspend the kids who were not involved. The principal should get everybody who was in the cafeteria when this happened and has to tell everybody what was the cause of this and decide how this should be solved. I also agree with everyone's comments
ReplyDeleteI think that the kids have the right to hear about there case.Also i don't agree with the school board for punishing the kids that didn't do it or don't have complete proof of who was in the fight.I would be really mad if i wasn't involved in the fight but was still suspended even though i didn't do anything.
