Gun Control Laws: Who has the power-State or National? Why?

    I think that in this case, the federal government is making excuses. Technically, the State government has the power here. The state controls all things involving schools, while the federal doesn't have any control. If this was involving drugs, or a US law, then the national government could do what they are doing. I'm on the side of the kid :D

  2. I think that Lopez had the stronger side because in the constitution it does not say that congress can control schools, it's up to the states. There for if the states were to say something than it would be okay but since it's congress Lopez has a good point.

  3. In this issue, the state should have the power because it doesn't say that you can do this in the constitution. Also, guns aren't necessarily dangerous. The Constitution does not give the National Government power to enforce laws in schools. It said that states have the power in schools.

    I believe that the government should win only because the kid had no reason to be carrying a 38 gun. If he was in danger he should have reported to somebody but he didn't so there is no reason for a gun. Also the government thought it was such a disturbance that they created a law that you can't carry a gun onto ANY school property unless you work for the police.

  6. The government's explanation sounds like an excuse. I mean, it's true, but if they talk like that, then they can control everything. That's not what they agreed to, they need to share power with the states. Anyway, the law affects education a lot more than commerce. Lopez just wants to get out of trouble, and as much as I dislike that, I have to agree with him about the distribution of power.

  7. In this court case the defendant, Lopez, in my opinion has a way better argument. The federal government in the case is just trying to find a round about way to make the kid guilty. In the constitution it does not say anything about the Federal government being able to decide anything for the schools. So I think to kid will win.

    To me i think that the government will win the fight cause in the first place there's no reson but a criminal reason for the boy to take that gun to school. Every state had to follow the law where it said that guns where not allowed on school property.

  10. I think the school should win. because if he brings a gun to school then everyone is going to want to bring a gun. which then lead to deaths then it makes the school and even the state look bad. so i think the school should win the whole court case about the schools gun rules.

  11. In my Opinion, State has the power for this debate. Technically, Lopez should win this, because in the constitution, it says that everything that hasn't specifically been stated in the constitution, is in states power. They shouldn't have taken it to federal court. The state should have given the punishment. I think he was most likely punished for having a gun and bullets on school property. While he did have a good argument.

  14. I think the kid has a better argument. The kid has carried a 38 gun and that's bad he should be punished by the state law not the government law. he cant be punished so bad because the government cant get involved in the school rules because it was not in the congress.

  16. Congress cannot violate the Bill of Rights. The second amendment of the Bill of Rights says that all citizens (unless a felony is committed) have the right to bare arms. So, it's not congress' place to take away that right, school zone or not. I think it should be the state's decision.

  17. I think that the state should win because they should have concerned or asked for the consent of the state before they went and made the law that the gun shouldn't be allowed near the school. No where does it say in the constitution about the guns having to stay away from the school because then in that case police officer shouldn't be able to have their hand guns because they are not above the law.

  18. Alfonso should win the case because the states are the ones who control schools because it's a reserved right. The government's argument was really far fetched anyhow.

  19. Lopez (the state) should win this case. they are correct in saying that the government should not be able to create this law, because anything to do with education is left up to the state. though i agree with the law, the federal government didn't have the right to make it.

  21. Lopez should win the court case. Guns in schools have nothing to with trade, so Congress was wrong by saying that. I still don't understand why Lopez had the gun in school, but his point was more valid. Lopez should still get punished, but Congress should leave that decision up the the state of Texas

  22. I think Lopez should win because we don't know the reasoning for bringing a gun to school. And the government is taking it way out of proportion with saying that they control trade so they have a write to put him in jail when none of this has anything to do with controlling trade.

But then again i see where the congress thought that it could lead to crimes.. But also Lopez should not have brought a gun with bullets to school.. He had no reason at all to!!

    The goverment is just making excuses, they just wanted to win.
    Trade has nothing to do with having a gun at school.
    The state should be the one to make the desicion on wether to have a gun at school or not.
    But then again why do u need a gun at school, Its school people!!
    Ur there to learn or watever.

    The fact is that Lopez (State)
    Should win...they should have the right to make the desicion for themselves.
    Parents and kid should vote for hat they think is safer or for what they want.

  25. Both sides have a great points, but it is unconstitutional because That wasn't mentioned so it has to go to the state plus it should go to the states because it goes with the schools. So in my opinion Lopez, or states, should win.

  27. I think Lopez should win, because he put up a really good argument with the government. also what if Lopez was using it for protection against a bully but didn't tell the teachers about it and if he did, the bully would beat him up.

  28. Lopez;it is very true that in the constitution, in doesn't say that national congress can make any laws about school. When the national congress said that that had to do with trading, they were getting WAY too detailed and you can do that with any thing, ex:everyone in the country should where seat belts because if one state does and one state doesn't then the one who doesn't will have more accidents and then the insurance bill will go up and on and on. I think the national government was getting a little too much like the king, making an excuse to get their way, and they shouldn't do that.

  29. I think that Lopez has the right to say what he did because its true, the states are the one who should make that law. And the deffence that the National Goverment has is trying to say that it has something to do with trade, when that is like waaaay out there...you have to be looking really closely to see that it has the tiniest bit to do with trading..but i think that the National Goverment will win just because they are more in power.

  30. Lopez had a good argument, but I'm not sure if guns in schools is a good thing. The national government can not make states laws so he had a good point. Only the state could have made that law. The national government were not following the rules of the constitution. Also all the problems the national government were coming up with were a little blown out of proportion. I can see their point also, though.

  32. I think Lopez has a better argument because congress can not make laws for the state and if the state wants the law they will make it. It says in the constitusion that states get to make the school laws so congress does not hav the right to make that law.

    I think that Congress is being too controlling in this situation. They should have not been able to pass the Gun-Free School Zones Act in 1990. Lopez and his lawyer definitely have a good point. Congress should have given states more power and not passed that law! Bad Congress!

  35. I think that technically the State should win. Even though no guns on school grounds is a good law, it's not the National government's job to make laws about schools. Nowhere in the constitution does it say anything about schools, therefore it should be the State's job to make laws. The State should win.

  36. I think that Lopez has the better argument because the national government shouldn't have published the law, the states should have. This argument talks about the 10th amendment because it isn't in the constitution. Therefor, the states, and only the states, have the power to make that law. The national government is only trying to make accuses to win.

    I chose the state because the man(who is supposed to be a criminal) has a point. They have no proof that it isn't illegal to have a gun in school. No, it is not right, but it isn't in the declaration of independence. They need more proof to make him guilty.

  38. I think that the state/Lopez will win. For one the constitution doesn't say the government can tell the states they cant have guns near school. Also the government doesn't know if having guns in school will affect businesses, money, etc.

  39. I'm on the side of the government because the problem with the gun on the kid is that it could affect other cities then maybe states. The kid could have shot somebody. The kid could affect the taxes (money). Nobody will won't to go there until that kid is in jail. They might not won't their kid to get shot.

    First of all guns in school areas doesn't make sense only if is the police.i think that the national government most or have the power to do this.the national government should just make it a national law not a state law so that it doesn't interfere with the constitution.

  45. I think that Lopez should win this case. Because if one person brings a gun to school then everyone will want to bring guns to school. So that will cause a lot of deaths. And then people that are moving from other states wont want to move here because of the fact people are bringing guns into schools. And in the constitution it says that that the state government has the power to make laws about schools.

This case did happened on school ground, which means that the law should have only been able to become a law by the states, not the national government.

  48. I think that the government over powers this case. The kid brought a gun to school and could of harmed someone. If gun violence is happenig there who would want to go the school. so nobody would come from another town, city, or state of they here about this. Also if they let kids bring guns to school crime rates will be higher. This is Crazy!

I do think that he shouldn't have brought a gun to school no matter what. It causes worry and people panic. Plus congress shouldn't be able to pass national laws unless all the states agree on it.

  52. I think that Lopez has a better chance of winning the court case. Congress has no power to make laws for the states and the argument made by the congress was weak. Lopez didn't use the gun so i don't see the big problem,but i see what the congress is trying to say that it's unsafe for students and teachers to have guns on school property.

  54. I am on the side of the government because if there was gun violence in schools who would want their kids to even be near the school let alone go to it. Also if they are allowed in school than the guns are bound to be every where else in the town.Than if other states hear about this who would want to trade with them or put shopping place there because of the guns there.

  58. I think Lopez(the state) should win because it wasn't in the constitution, but he prob shouldn't have had the gun in school in the first place. He should have known better. It could of caused fights or BIG problems. I think its the states rights to make the gun or not. If they let kids bring guns to school it will cause the murder rate to RISE so i think they should make the law.

  59. Congress didn't have the power to make the law because nowhere in the constitution does it say we can't bring guns to school. The only thing that says something about protection is "Provide for the Common Defense" So they don't have the power to pass that specific law.

  70. i think that congress should win because its not right for a kid to have a gun in school cause nobody know what he was gonna go and do with it.. lets say if they did let pass a law saying that its ok to take a gun to school than all of a sudden all these kids are shooting each other than a lot of people wouldn't want to go to school and all the schools wouldn't have anybody going there. so therefor it would go out of business

  73. I think that they did the right thing by arresting Alfonso Lopez. It is a very good law to ban guns from school because with guns in school their is a higher chance of some one getting murdered and instead of just fist fighting people will shoot each other. So I think Lopez should lose the battle.

  74. i think Lopez should win because it wasn't in the constitution. but he also shouldn't have had the gun there in school because who knows what could happen. He could have gotten into a fight and accidentally or on purpose he could have hurt another student. i think that the states have the rights to chose whether or not they want guns in the school. but if they do want guns in the school they should probably give them to the teachers or any other adult, because the students may get into a fight and shoot each other and that would be BAD!!!
