1st Amendment in Schools: Santa Fe Independent School District v. Doe

In June 2000 the Supreme Court issued a ruling in this case. What are the constitutional and legal issues raised by this case? Suppose you were writing the Court's opinion. In whose favor would you decide-the school district's or the families'?

  1. My opinion is in favor with the students who want to pray. They aren't forcing anyone to come to the game, and the only ones that complained about the prayer were NOT students on the football team, on the cheer squad, or in the band. They were families watching the game and a student watching the game. These people complaining did not have to go to the game.
    Also, the prayer was said by a student, not a teacher. The student has the right to pray whenever and however he wants. (First Amendment) Students also have the right to assemble. (First Amendment) So, he did nothing wrong.

  4. I think that the Santa Fe school district should win the case. Though prayer in school is illegal, pray at an out of school event should not be. In their argument, Doe kept saying that children should not be forced to participate in prayer. Who's forcing them?? Many of the children do not have to go to the game (excluding band members, football players, etc.), and even if they do, they can step out during that time or just not participate in the prayer. Also, this tradition is student led. They vote to say if they even want the prayer, and if they do, which student leads it.

  6. In this case it seem that the 1st Amendment was being broken.
    And i guess i would have to take the side of the school district.
    Because we have the right to practice any religion,sometimes when you live in certain places everyone practice the same religion.
    Here in Virginia,I think Christianity (In many Forms) is the most practice or follow.
    And when we all practice the same religion we kinda want to share it with others, just like the kid at the football game.

    If this young lady felt uncomfortable, because she was Hindu.
    She should have just got out of there or just stop listening to it.

    I've been in a case where i felt uncomfortable when i wasn't fitting in with the people i was sorround by...i was in a room filled with Muslim people and i was the only Chritian, and trust me they could tell i was.

    So, i take the school district side.
    We weren't forcing the girl to stay and listen, if she felt uncomfortable being she should have left.

  7. I agree, Bethany, and when you said excluding football players, band members, etc., it never says that they had a problem with they prayer. So I totally agree with you, no one's forcing them.

  9. My Opinion is that no one was forcing her to go to the game and she should have stayed home,or she could have gotten out of the circle or huddle. This girl should have got out of there if she was uncomfortable with it. I think that it is alright to pray before the game. It is Constitutional in the Bill of Rights that there is a freedom of Religion.

  10. I think that if you want to pray at a football game you can. I mean who is making the people that don't belive in god or other god pray. In the first amendment it says we are allowed to practice any religion you would desire. I think that is so cool.

  11. my opinion is that they should pray before every game. Because we the JV Central falcons pray before every game to get a better chance of winning. i think if the girl felt unconformable she should have left and kept her mouth shut. this is the first amendment witch says they have the right before every game to pray on the field

  13. i think that the kids should have a right to pray because the first amendment clearly says that they can choose any religion that they want to pick.. i would agree with the kids about how they should be able to pray when ever they want

  15. I agree with Will b/c you do have the right to pray before a game if you really want to and yeah if that woman feels uncomfortable then she shouldn't be there or that least come late so you don't have to hear the players say the prayer.

  17. i think that if you want to pray at a game than you can. its not like people who believe in god are making the people who don't believe in god pray. Besides if a person from a different religion doesn't like praying before a game then that person shouldn't go, i mean its not like someones holding a gun to there heads and saying "Go to that game and pray" so i think its any persons choice

  18. In this situation the first amendment is brought up beacuse you have the freedom of religion. Yea maybe there were people at the game who didnt believe in the same god but who said they had to come, no one. So the families who are so dedicated to their religion should at least let people beilive what they want.
